Sub: Payment of Night Duty Allowance pursuant to recommendations of 7th CPC – Reg.
Ref.: Railway Board’s letter No.E(P&A)II-2017/HW-1 dated 29.09.2020(RBE No.83/2020)

This refers to AIRF’s letter, bearing number even dated 31st July, 2020, on the above subject matter.

It is a matter of serious concern that, while issuing above cited circular of Railway Board, no cognizance has been given to our letter dated 31st July, 2020, whereby it was amply clarified that, Railway Staff are paid Night Duty Allowance, based on the recommendations of Justice Miabhoy Tribunal and as per recommended formula of the 7th CPC, under paras 8.17.71 to 8.17.77.

It was further explained that, payment of Night Duty Allowance to Railway Staff is governed by O.M. dated 04.10.1989 of the DoP&T(related to Railwaymen). Railway Board have already accepted and implemented recommended formula of the 7th CPC, as envisaged under para 8.17.71 to 8.17.77 of 7th CPC recommendations, and issued orders of revision of Night Duty Allowance w.e.f. 01.07.2017 vide RBE No.36/2018 dated 08.03.2018.

Since Indian Railways is operating 24X7 round-the-clock throughout the year in all weather conditions and seasons of our country, Railwaymen, irrespective of their grade or pay scale, are bound to perform Night Duty between 22:00 to 06:00 hrs. to keep the wheels moving. Therefore, capping of upper pay limit of Rs.43,600, for entitlement of Night Duty Allowance, is highly unjustified and irrational. It is not understood, as to why this type of orders have been issued by the Railway Board vide RBE No.83/2020 dated 29.09.2020.

Since there is serious discontentment and unrest amongst the Railway Staff, who are in higher scale of pay and regularly performing Night Duty, the above orders of the Railway Board dated 29.09.2020 be kept in abeyance, and there should be no question of any recovery on implementation of these irrational orders.

This may kindly be treated as “Most Urgent”.
